The People of the State of Illinois
vs.
John McROY

The People of the State of Illinois, chosen, selected and sworn, in and for the County of Saline in the name and by the authority of the People of the State of Illinois, upon their oaths present; That John McRoy late of said County, on the tenth day of April in the year of our Lord one thousand eight hundred and seventy four with force and arms in and upon the person of one SAMUEL CLEAVELIN in the peace of God of the said People then and there being feloniously and wilfully did then and there make an assault and the said John McRoy with a certain iron weight which he the said John McRoy in his right had then and there had and held.  The said Samuel Cleavelin in and upon the right side of the head of him the said Samuel Cleavelin then and there feloniously and wilfully did strike and penetrate giving to him the said Samuel Cleavelin then and there with the iron weight aforesaid in and upon the right side of the head of him the said Samuel Cleavelin one mortal wound of which said mortal wound the said Samuel Cleavelin from the hour of two o'clock in the afternoon of the said tenth day of April in the year of our Lord one thousand eight hundred and seventy four until the hour of six o'clock in the afternoon of the same day at the county and state aforesaid did languish and languishing did live on which said tenth day of April in the year aforesaid the said Samuel Cleavelin at the county and state aforesaid of the mortal wound aforesaid died, and so the jurors aforesaid upon their oaths aforesaid, do say that the said John McRoy him the said Samuel Cleavelin in the statute in such a case made and provided, and against the peace and dignity of the said People of the State of Illinois.---James M.
